Terms and Conditions – Wavrr

1. Introduction

Welcome to Wavrr, operated by Blink B.V. (“Company”, “we”, “our”, “us”).
These Terms and Conditions (“Terms”) govern your use of the Wavrr platform, including digital consent forms, ink passports, and related services for tattoo studios, artists, and clients (collectively, the “Service”).

By accessing or using Wavrr, you agree to be bound by these Terms.
If you do not agree, you must not use the Service.

2. Definitions

• User: Any individual or business using Wavrr.

• Studio: A tattoo studio using the Service.

• Artist: A tattoo artist using the Service.

• Client: An individual completing or signing a digital consent form via Wavrr.

• Content: Any data, images, text, or other materials uploaded or submitted to the Service.

• Subscription: The paid access plan for the Service.

3. Account Registration

• To access certain features, you must create an account.

• You are responsible for maintaining the confidentiality of your login credentials.

• You must provide accurate, current, and complete information.

• Accounts found to contain false or misleading information may be suspended or terminated.

• You are responsible for all activity under your account.

4. Subscription and Payment

• Access to Wavrr requires an active paid subscription.

• Payments are processed securely through our third-party payment provider.

• All fees are stated in euros (€) unless otherwise specified and are non-refundable, except as required by law or explicitly stated.

• We reserve the right to adjust pricing or subscription plans with reasonable prior notice.

• Failure to pay may result in suspension or termination of your account.

5. Use of the Service

• You agree to use Wavrr only for lawful purposes and in accordance with these Terms.

• You must not misuse, copy, reproduce, modify, distribute, or reverse-engineer any part of the Service.

• Studios and artists are solely responsible for the accuracy and legality of their consent forms and compliance with local regulations.

• Clients are responsible for providing truthful and accurate information on consent forms.

• Blink B.V. is not responsible for the relationship, agreements, or disputes between studios, artists, and clients.

6. Consent Forms and Sensitive Data

• Wavrr enables the creation, signing, and storage of digital consent forms and ink passports that may contain sensitive information (e.g., health-related disclosures).

• By signing or submitting such forms, the Client provides explicit consent for the processing and storage of this information under applicable GDPR rules.

• Studios and artists are considered data controllers for the consent forms they create and manage; Blink B.V. acts as a data processor providing the technological platform.

• Studios and artists are responsible for obtaining all legally required consents and ensuring compliance with local laws.

7. Cancellations and Refunds

• Tattoo studios and artists manage their own booking, cancellation, and refund policies.

• Blink B.V. does not intervene in or assume responsibility for disputes between clients and studios or artists.

8. Intellectual Property

• All software, design elements, and content within Wavrr are the exclusive property of Blink B.V. or its licensors.

• You may not copy, distribute, modify, or create derivative works without our written consent.

• You retain ownership of the content you upload but grant us a limited license to host, process, and display it solely for the purpose of operating the Service.

9. Data Protection and Privacy

• We handle personal data in accordance with our Privacy Policy.

• By using the Service, you acknowledge that your personal data and that of your clients may be processed in accordance with the GDPR and our Privacy Policy.

• Tattoo studios and artists must ensure their own compliance as data controllers when collecting client data via Wavrr.

10. Service Availability

• We strive to ensure uninterrupted access to Wavrr, but we do not guarantee that the Service will always be available or error-free.

• Maintenance, updates, or technical issues may temporarily affect availability.

• We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.

11. Limitation of Liability

To the maximum extent permitted by law:

• Blink B.V. shall not be liable for any indirect, incidental, or consequential damages arising from your use of Wavrr.

• We are not responsible for the accuracy, legality, or content of information submitted by Users.

• Our total liability for any claim relating to the Service will not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

12. Termination

• We may suspend or terminate your account if you violate these Terms, misuse the Service, or fail to pay applicable fees.

• You may terminate your account at any time by contacting support@useblink.app

• Upon termination, your right to access the Service will cease, but relevant data retention obligations (e.g., legal recordkeeping) may continue as described in our Privacy Policy.

13. Changes to These Terms

We may update these Terms from time to time.
When changes are made, we will post the updated version on https://wavrr.app/terms and update the effective date above.
Continued use of the Service after such updates constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.
Any disputes arising under these Terms shall be resolved exclusively by the competent courts in Amsterdam, the Netherlands.
